ASSUMPTION OF RISK AND RELEASE OF LIABILITY AGREEMENT
In exchange for participation in gymnastics training and activities organized by Coastal Realm Gymnastics, of 6201 Associated Blvd Suite 101, Everett, Washington, 98203, and/or use of the property, facilities, and services of Coastal Realm Gymnastics, I agree for myself, and (if applicable) for the members of my family and/or the minors I supervise or have legal guardianship of, as follows:
1. AGREEMENT TO FOLLOW DIRECTIONS
I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Coastal Realm Gymnastics, its employees, representatives, or agents.
2. ASSUMPTION OF RISK AND RELEASE
I understand and acknowledge that participation in gymnastics involves inherent risks, including but not limited to falls, collisions, and other potential causes of serious injury, disability, or death. I voluntarily assume all such risks, whether foreseen or unforeseen, and accept full responsibility for any injury, loss, or damage to myself, my family members, or the minors in my care.
I HEREBY RELEASE AND HOLD HARMLESS COASTAL REALM GYMNASTICS, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY AND ALL LIABILITY FOR INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF MY OR MY CHILD’S PARTICIPATION, WHETHER CAUSED BY THE NEGLIGENCE OF COASTAL REALM GYMNASTICS OR OTHERWISE, to the fullest extent permitted by law.
3. INDEMNIFICATION
I agree to indemnify and defend Coastal Realm Gymnastics against all claims, causes of action, damages, costs, and expenses (including attorney fees) that may arise from my or my family’s participation in the activities or use of the facilities.
4. DAMAGES
I agree to pay for any damages to the facilities caused by the negligent, reckless, or willful actions of myself, my family members, or minors in my care.
5. CONSENT FOR MINORS
I certify that I am the parent or legal guardian of the above minor(s) and consent to their participation in gymnastics activities. I agree on behalf of said minor(s) to all terms of this Agreement. I understand that I cannot release the minor’s rights to pursue claims for gross negligence or intentional acts.
6. MEDICAL AUTHORIZATION
In the event of an injury to myself or a minor in my care, I authorize Coastal Realm Gymnastics to arrange for emergency medical treatment as deemed necessary. I agree to be fully responsible for any and all medical expenses incurred.
7. PHOTO/VIDEO RELEASE
I grant Coastal Realm Gymnastics permission to use photos or videos of me or my child(ren) for promotional purposes, without compensation and without limitation on time or medium.
8. SEVERABILITY
If any portion of this Agreement is found to be invalid, the remaining provisions shall continue to be enforceable.
9. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Washington.
10. ACKNOWLEDGEMENT OF UNDERSTANDING
I have read this Agreement, understand its terms, and agree to be bound by it. I understand that by signing this document, I am giving up substantial legal rights, including the right to sue.
